These Terms and Conditions regulate the use of the Natural Value Performance website  (hereinafter also referred to as NVP), so it is recommended to read them before continuing this visit/analysis.

The entities that own this website are  NBI – Natural Business Intelligence, NIPC 515935239, headquartered at Régia Douro Park 5000 – 033 Andrães, Vila Real, Portugal, hereinafter also referred to as NBI, and L.C.S.D – Data CoLAB Association – Collaborative Laboratory for Data-Driven Innovation Services, NIPC 516540068, headquartered at Avenida de Cabo Verde,  Lote 1, 4900-568 Viana do Castelo, hereinafter also referred to as Data CoLAB.

Throughout the website, the terms “we”, “us”, “our” and “Owning Entities” refer to both of the aforementioned entities (NBI and Data CoLAB).

For the purposes of these Terms and Conditions, the concepts listed below shall have the following definitions:

2.1. “NVP Platform” corresponds to the https://www.app.nvp.pt domain, and is governed by the Terms and Conditions contained in the said domain.

2.2. “Website” corresponds to the domain https://www.nvp.pt and is governed by these Terms and Conditions.

2.3. “Contents” of the Website corresponds to all the information contained in this website, namely, texts, images, photographs, videos, illustrations, logos, symbols, graphic design and web design.

2.4. Website “Services” means the “baseline” services provided through the NVP website. In addition, other services may be provided as requested by the Users.

The purpose of this Website is to present the NVP Platform, to promote the dissemination of information related to it and its commercialization.

  1. Acceptance of Terms and Conditions

The Owners provide the User with the https://www.nvp.pt website, as well as all its information, tools and services available, upon acceptance of all terms, conditions, policies and notices contained therein.

By accessing any part of the website you are using our “Services” and therefore agree to the Terms and Conditions, which apply to all Users.

If you do not agree to all of the Terms and Conditions stated herein, you should not access the site or use any services derived from it.

The Terms and Conditions of Use and the Privacy Policy constitute a contract between the User and the Entities that own the https://www.nvp.pt domain and apply to the use of this website.

The Owners disclaim any warranties, express or implied, in relation to the use of this website.

NBI and Data CoLAB cannot guarantee uninterrupted, secure or error-free access to this website, or that any errors will be corrected in a timely manner.

As a User, you hereby agree that you are solely responsible for the use of any material or information and you further accept that you are solely responsible for any damage that may be caused to the operating system or software of the device used to access this website or for any loss of data that may result from the download of content or information contained on the website.

NBI and Data CoLAB jointly reserve the right to interrupt or suspend access to the website, for the period they deem necessary, for any technical, administrative, force majeure or other reasons. Without prejudice to the foregoing, the Owner Entities may not be held liable for any suspension or interruption of access that may occur for reasons that are not attributable to them or that are attributable to mere negligence.

  1. Personal data

By making available, on this website, our Privacy and Personal Data Protection Policy, we intend to make known to Users the general rules for the processing of Personal Data, which are collected and processed in strict respect and compliance with the provisions of the applicable Personal Data Protection legislation in force, namely, Regulation (EU) 2016/679,  of the European Parliament and of the Council of 27 April 2016 (also referred to as the “GDPR”).

The retention of this personal data allows the Owners of this Website to continue to provide personalized services to their Users, without interruptions.

With the exception of entities that provide services related to the operations of this website, NBI and Data CoLAB will not share the personal data that the User provides to them with third parties, except as provided for in the GDPR.

  1. Compensation

In case of violation of the provisions of these Terms and Conditions, of any law or of the rights of a third party, the User agrees to indemnify, defend and hold harmless the Entities Owners of this website, in relation to all damages that they have suffered or will suffer as a result of such act(s).

  1. Transmission

These Terms and Conditions of Use, as well as any rights and licenses granted hereunder, may not be transferred or assigned by you.

Notwithstanding this, such rights and licenses may be assigned, in writing, by the Owning Entities to third parties, without any restriction.

  1. Applicable Law and Jurisdiction

 15.1. In case of omission or difficulty of interpretation arising from these “Terms and Conditions”, Portuguese law shall apply.

15.2. Any conflict arising under these “Terms and Conditions” shall preferably be resolved amicably between the Parties.

15.3. If attempts at amicable negotiation are unsuccessful, the dispute shall be referred to arbitration, in accordance with the legal arbitration rules in force in Portugal.

  1. Independence

If a provision of these Terms and Conditions is found to be unlawful, void or unenforceable, it shall survive and enforce to the fullest extent permitted by law. Subsequently, that clause will be deleted from these Terms and Conditions.

Such determination of illegality, nullity or unenforceability of a provision shall be without prejudice to the validity and enforceability of any other provisions contained in these Terms and Conditions.
